Terms & Conditions

To ensure a correct understanding between Ukhozi Tours and yourself, we have created these Ts&Cs to clarify our relationship. Please read them. Accepting our Quote means you have agreed to them.

1. By using our services, you agree to the following terms and conditions between Ukhozi Tours and yourself.

2. The information contained in this website is an invitation to do business and not an offer.  If you forward an request to us, Ukhozi Tours will indicate acceptance by return e-mail and this will become a binding agreement between yourself and Ukhozi Tours. Services means the trip, including accommodation, transfers, transport, fees, and all incidental expenses except personal expenses such as liquor, airtime, data, or items of a personal nature.  

3. Ensure all details supplied by yourself are correct. We accept no responsibility if information differs.

4. All prices are quoted in ZAR (South African Rands) and recommend you purchase travel insurance to give yourself cancellation cover. All cancellations and amendments must be in writing. The Exchange Rate for any transaction will be fixed at the date of the quote.

5. It is the passenger's responsibility to have the correct travel documents and meet all visa and health requirements.

6. Any discounts are applied only upon the full and final payment. If payment is not received in time, we reserve the right to release your reservation, regardless. We will use our best efforts to contact you prior to taking this action and will remind you of payments due. Any changes resulting in cost differences will be for your account. Increases that occur we have no control over will be for your account. This can be as a result of factors including, but not restricted to, Government Tax increases or Park Fee increases.

7. While we do insure you while you are with us, we suggest you take out both comprehensive travel and supplier default insurance. This does not replace the comprehensive travel insurance we recommend above, but provides cover if a third party supplier is unable to provide services or products due to its own financial failure and you are unable to recover the costs in any other way. Should you fail to obtain comprehensive travel insurance timeously, all and any costs arising from the possible need to cancel, re-route or follow different travel arrangements including an emergency medical procedure will be for your own cost and Ukhozi Tours indemnifies itself from any and all claims in regard thereto.

8. Responding to child trafficking, South Africa announced tough regulations for families traveling with children. Some of these regulations have recently been amended. We suggest you check the current situation before travelling. Currently, Non-South African Citizens traveling to SA will still be required to submit an original birth certificate and, as necessary, parental consent or certified copies during the visa application process. For visa-exempt countries a strong advisory has been issued, with travelers advised having proof of relationship and consent from the absent parent/s or guardian/s, in case they are asked to provide such on arrival. A child is traveling alone to South Africa must carry a letter from the person receiving them in South Africa, containing the person’s address and contact details, as well as a copy of the host’s identity document or passport (in this case it is probable that no birth certificate will be required). Please check with your embassy. (continued below)

9. We keep all your information strictly private. We NEVER make any information available to third parties unless required by law. This site may use “cookies” to make your web visit more user-friendly. Our cookies cannot harm you or your devices.

10. Ukhozi Tours, its employees, agents and associates will not be liable for any damage of whatsoever nature arising or resulting from the use of or inability to use this site or the information contained hereon, including but not limited to direct, indirect, incidental, punitive and consequential damage.

11. This site is created, maintained and controlled in the Republic of South Africa and as such, the laws of the Republic of South Africa and the jurisdiction of the South African Court govern this user agreement and the use or inability to use this site.

12. Ukhozi Tours reserves the right to make changes to this site and this user agreement at any time without notice. Any reference to the singular shall include reference to the plural and vice versa while any reference to gender includes reference to both genders and any reference to natural persons will include reference to legal entities.

13. We cannot be held responsible for any defects, changes or cancellations in the bookings or trips, which includes, but is not limited to, delays, loss or damages arising from any causes, including dissatisfaction with the booking ,or any loss, damage or delay caused by the suppliers or any third party. Ukhozi Tours, its directors, staff, employees, agents and assigns are hereby indemnified by yourself against any claim for loss or damage whatsoever that may arise or have arisen in connection with any services supplied or offered by or in connection with any third party. Any claim or claims which you, your agent, executor, heirs or assigns may have for any compensation for damages or loss, or the like from Ukhozi Tours resulting from injury or any loss occasioned whatsoever, are hereby irrevocably waived and this includes any transportation to or during the trip as well as any illness , injury or death arising during or after the trip.

14. Any errors on our website, brochures or other advertising or marketing material with regard to pricing, will be corrected by Ukhozi Tours as soon as it is brought to our attention and Ukhozi Tours cannot be held bound thereby.

15. Any complaint(s) must be addressed in writing to Ukhozi Tours via email to david@ukhozitours.co.za. We take complaints very seriously and will respond as soon as possible and make every effort to resolve any dispute, and keep communication channels between us open. However, it cannot be guaranteed that any dispute will be resolved to your satisfaction, as resolution may be beyond our control.

16. If you are suffering from any illness or disability, or are undergoing any medical treatment, you must declare this openly and honestly to Ukhozi Tours at the time of booking. It is your responsibility to make arrangements for the provision of any medication or treatment while you are with us that are not emergency related. Failure to declare any conditions, illnesses, disability or the like, will constitute a breach of these terms and conditions and can result in you being excluded from your booked trip or excursion without refund of any payment.

17. No variation, amendment, addition or deletion of these terms will be binding unless expressly agreed to by both parties, in writing. From time to time, updated and amended terms and conditions will be necessitated due to changes in policy, administration and legislative alterations. Please ensure that you are familiar with the most recent document.

18. No relaxation or indulgence will constitute a waiver of these terms and conditions and both parties remain entitled to their rights as ascribed to them in terms hereof, despite not insisting on them at any given time. Should any of the terms and conditions as found herein be deemed to be invalid or null and void as determined by a court of law, the rest of the provisions will remain in full force and effect.

19. No responsibilities, rights or obligations in terms of these terms and conditions can be assigned or ceded by you to a third party.

20. The parties choose domicilium et executandi (domicilium address) for the purposes of giving any notice, the payment of any sum, the serving of any process and for any other purpose arising out of these terms and conditions and any ancillary documents, their addresses as follows:
